ARTICLE 10 - Propriété intellectuelle
Le contenu du site internet "www.mercidistillery.com" est la propriété du Vendeur et de ses partenaires et est protégé par les lois françaises et internationales relatives à la propriété intellectuelle. Toute reproduction totale ou partielle de ce contenu est strictement interdite et est susceptible de constituer un délit de contrefaçon.
En outre, Le Vendeur reste propriétaire de tous les droits de propriété intellectuelle sur les photographies, présentations, études, dessins, modèles, prototypes, etc, réalisés (même à la demande du Client) en vue de la fourniture des Services au Client. Le Client s'interdit donc toute reproduction ou exploitation desdites études, dessins, modèles et prototypes, etc, sans l'autorisation expresse, écrite et préalable du Vendeur qui peut la conditionner à une contrepartie financière.
ARTICLE 11 - Droit applicable - Langue
Les présentes Conditions Générales de Vente et les opérations qui en découlent sont régies et soumises au droit français.
Les présentes Conditions Générales de Vente sont rédigées en langue française. Dans le cas où elles seraient traduites en une ou plusieurs langues étrangères, seul le texte français ferait foi en cas de litige.
ARTICLE 12 - Litiges
TOUS LES LITIGES AUXQUELS LES OPERATIONS D'ACHAT ET DE VENTE CONCLUES EN APPLICATION DES PRESENTES CONDITIONS GENERALES DE VENTE POURRAIENT DONNER LIEU, CONCERNANT TANT LEUR VALIDITE, LEUR INTERPRETATION, LEUR EXECUTION, LEUR RESILIATION, LEURS CONSEQUENCES ET LEURS SUITES ET QUI N'AURAIENT PU ETRE RESOLUES ENTRE LE VENDEUR ET LE CLIENT SERONT SOUMIS AUX TRIBUNAUX COMPETENTS DANS LES CONDITIONS DE DROIT COMMUN.
Selon l'article L.612-1 du Code de la consommation, il est rappelé que « tout consommateur a le droit de recourir gratuitement à un médiateur de la consommation en vue de la résolution amiable du litige qui l’oppose à un professionnel. A cet effet, le professionnel garantit au consommateur le recours effectif à un dispositif de médiation de la consommation ».
A ce titre Mercidistillery SARL propose à ses Clients Consommateurs, dans le cadre de litiges qui n'auraient pas trouvé résolution de manière amiable, la médiation d'un médiateur de la consommation, dont les coordonnées sont les suivantes :

ARTICLE 13 - Information précontractuelle - Acceptation du Client
Le fait pour une personne physique (ou morale), de commander sur le site Internet "www.mercidistillery.com" emporte adhésion et acceptation pleine et entière des présentes Conditions Générales de Vente et obligation au paiement des Produits commandés, ce qui est expressément reconnu par le Client, qui renonce, notamment, à se prévaloir de tout document contradictoire, qui serait inopposable au Vendeur.

ARTICLE 10 - Intellectual Property
The content of the website "www.mercidistillery.com" is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an offense of counterfeiting.
In addition, the Seller remains the owner of all intellectual property rights on photographs, presentations, studies, drawings, models, prototypes, etc., made (even at the Client's request) for the provision of Services to the Client.
The Client is therefore prohibited from reproducing or exploiting said studies, drawings, models, and prototypes, etc., without the express, written, and prior authorization of the Seller, which may condition it to a financial consideration.
ARTICLE 11 - Applicable Law - Language
These General Terms and Conditions of Sale and the resulting transactions are governed and subject to French law.
These General Terms and Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
ARTICLE 12 - Disputes
ALL DISPUTES TO WHICH THE PURCHASE AND SALE TRANSACTIONS CONCLUDED UNDER THESE GENERAL TERMS AND CONDITIONS OF SALE MAY GIVE RISE, CONCERNING THEIR VALIDITY, INTERPRETATION, EXECUTION, TERMINATION, CONSEQUENCES, AND FOLLOW-UPS AND WHICH COULD NOT BE RESOLVED BETWEEN THE SELLER AND THE CLIENT WILL BE SUBMITTED TO THE COMPETENT COURTS UNDER COMMON LAW CONDITIONS.
The Client is informed that they can in any case resort to conventional mediation, especially with the Consumer Mediation Commission (C. consom. art. L 534-7) or to existing sectoral mediation bodies, or to any alternative dispute resolution method (conciliation, for example) in case of dispute.
ARTICLE 13 - Pre-contractual Information - Client's Acceptance
The fact for a natural person (or legal entity), to order on the website "www.mercidistillery.com" implies full and entire adherence and acceptance of these General Terms and Conditions of Sale and obligation to pay for the Products ordered, which is expressly recognized by the Client, who renounces, in particular, to take advantage of any contradictory document, which would be inapplicable to the Seller.
APPENDIX - PROVISIONS RELATING TO LEGAL WARRANTIES
Article L211-4 of the Consumer Code. The seller is obliged to deliver a product which conforms to the contract and is held liable for any lack of conformity which exists upon delivery.
They are also responsible for any lack of conformity caused by the packaging, the assembly instructions, or the installation if they were charged with responsibility or carried out under their responsibility.
Article L211-5 of the Consumer Code. To conform to the contract, the product must: - Be suitable for the use usually expected of a similar item and, where applicable: - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model - present the qualities that a buyer may legitimately expect given the public statements made by the seller, the producer, or his representative, particularly in advertising or labeling - Or have the features defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller's knowledge and accepted by the latter.
Article L211-12 of the Consumer Code. The action resulting from the lack of conformity lapses two years after delivery of the product.
Article L211-16 of the Consumer Code. When the buyer asks the seller, during the course of the commercial warranty which was granted to them during the acquisition or the repair of movable property, for a repair covered by the warranty, any period of immobilization of at least seven days adds to the remaining duration of the warranty. This period runs from the buyer's request for action or the provision for repair of the goods in question, if this provision is subsequent to the request for action.
Article 1641 of the Civil Code. The seller is bound to a warranty for the hidden defects of the thing sold which render it unfit for the use for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would have given a lesser price for it, had they known about the defects.
Article 1648 paragraph 1 of the Civil Code. The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect.
